Australian visas are among the world’s most popular visas and they process a large number of visas every year. However, the Australian government is much concerned about who they invite into the country. So, many visas get refused or rejected in the selection process. This is due to the strict rules and regulations of the Australian Department of Immigration and Border Protection.

Common causes for visa refusals

Applying for the wrong Australian visa

It is important to refer to a migration agent and research the type of visa you should apply. It should parallel with your needs and capabilities. There is a variety of visas available for you. Visitors, student, partner, family, business, and skill visa are some of those categories. There are even subcategories under the main ones. Each of these has a subclass number. They will surely reject your visa if you apply for the wrong subclass.

Inconsistency in application

Your application should be 100% accurate and consistent before submitting it. Inconsistency in an application could damage your reputation with the Australian government in many ways. Refusal of your visa is not the only bad effect of it. Such a damaged reputation could be a barrier when you apply for other visas in the future. So, it is always a good idea to register with a migration agent to ensure this.

Lack of evidence

Not providing sufficient and relevant documents for their application is the most common reason for visas to be refusals. Each of the visa subclasses requests different kinds and types of documents. It is best to consult a travel agent to get advice on this. On other hand, the documents you will require according to your visa may differ from one another.

Your history

Australian Department of Immigration and Border protection always look into your past visa history when processing your application. If they find that you have overstayed a previous they will remove your application. Likewise, if you have not complied with any conditions it asks for, your visa will be refused.

Failure to meet health requirements

You must prove that you do not pose any health and safety risk to the Australian community. They are more concerned about highly contagious diseases. If you are with such an illness you won’t be able to visit Australia. However, you can retry after the recommended treatments and successful re-tastings.

Failure to meet Character requirements

It is vital for the Australian government to be aware of any criminal convictions you may have. This is not just in Australia or your home country, but any country you have resided or visited. So, you have to convince the Australian government that you are a law-abiding citizen.

Supplying False and Misleading Documents

This will not only get your visa refused but you will also get a 3-year ban. Any chance of future applications of yours will have a high risk of refusal. Furthermore, it is also against the law to provide false legal documents. So, it is always wise to consult a professional when you are preparing your documents.

Visa appeal process

If the Department of Home Affairs of Australia refuses an application for a visitor, student, partner, family, business, or skilled visa, you can make an appeal. Here, you are asking the Tribunal to review the former decision.

It is important that you get professional advice immediately after the rejection of a visa. This is as there are strict time limits for making an appeal. You can’t extend any of these time limits. They also differ according to the place you are in and the reason for the rejection.

The processing time of these appeals could be anywhere around 12 to 18 months. You will also have to pay an additional application fee for the appeal application. If the Tribunal disagrees with the decision of the department to refuse your visa, They will forward your application to the Department of Immigration again. They will add new instructions and recommendations to the application this time.

Even if the Tribunal agrees with the decision of the department to refuse your visa, you have two more options. You can either forward your application to Federal Court or Ministerial intervention. But these should always be done after consulting with a professional.

Applying for a review is a very delicate and intimidating procedure and it needs to be done correctly. So, don’t hesitate to contact us at Immigration agent Sydney if you need a hand.
